The processing of personal data (hereinafter referred to as "data") by JMP Technology Services GmbH ("JMP") is always carried out in compliance with the EU General Data Protection Regulation (GDPR) and the country-specific data protection regulations applicable to JMP. This Privacy Statement informs users, customers, and clients (hereinafter referred to as "Clients") about the nature, scope, and purpose of the personal data collected, used, and processed by JMP.
These data protection provisions also apply to any data processing carried out by JMP on behalf of Clients, unless a separate Data Processing Agreement has been concluded (see Section 3.10 and 4).
All provisions and terms of the GDPR apply to this document.
JMP processes personal data of its Clients exclusively in connection with the provision and management of products or services and for billing purposes, in compliance with applicable legal requirements. For this data processing, JMP acts as a controller within the meaning of Art. 4 (7) GDPR. JMP ensures that all processing is carried out in accordance with the principles outlined in Chapter II of the GDPR and implements appropriate technical and organizational measures to protect the rights and freedoms of individuals.
The scope, duration, type, and purpose of processing are determined by the contractual agreements between JMP and the Client and the use of JMP services. Data is only processed for as long as necessary to fulfill the service, contract, billing, or applicable legal retention periods. Examples include:

When JMP processes data on behalf of Clients, it is based on contractual agreements. The Client remains fully responsible for compliance with data protection laws, especially regarding the lawfulness of data transfer to JMP.
The location of processing is determined solely by the Client, who may instruct JMP to process data within the EU/EEA or in specific countries/locations as required.
JMP processes data exclusively under the instructions of the Client, unless exceptions under Art. 28 (3)(a) GDPR apply. JMP will inform the Client if an instruction appears unlawful.
JMP implements an internal organization and technical and organizational measures in accordance with Art. 32 GDPR to protect data appropriately.
JMP ensures data security in accordance with Art. 32 (1) GDPR.
If a data subject exercises GDPR rights (e.g., access, rectification, deletion), JMP will forward the request to the responsible Client.
The Client authorizes JMP to involve affiliated companies within JMP's group as subprocessors, ensuring appropriate legal safeguards are in place.
JMP may engage subcontractors as subprocessors and maintains a list of subprocessors, which Clients can review and object to if necessary.
Liability between the Client (controller) and JMP (processor) follows Art. 82 GDPR.
These terms serve as a standard data processing agreement within the meaning of Art. 28 (2) and (9) GDPR, making a separate written contract generally unnecessary unless requested.
Clients may request a separate individual data processing agreement with JMP, which would override these standard terms for data processing.

The scope and duration of these terms are based on the services or contracts used by the Client.
These general data protection conditions remain valid for an unlimited period and are regularly updated on JMP's website in accordance with legal developments.
